This website is owned and operated by East Aviation LLC. These Terms set forth the terms and conditions under which you may use our website and services as offered by us. This website offers visitors Aviation related educational material and products. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms.

Purchases, Enrollment, Reservations, and Pricing

When purchasing an online ground-school course, reserving a discovery flight, or scheduling pilot-training services through East Aviation, you agree that:

You are responsible for reviewing the complete course description, flight or training description, eligibility requirements, prerequisites, prices, expiration dates, scheduling terms, cancellation and refund policies, and any other applicable conditions before completing your purchase or reservation.
When you complete the checkout or reservation process and submit payment or authorize a charge, you enter into a legally binding agreement with East Aviation for the selected course, flight, training service, package, or reservation. If the student has not reached the legal age of majority, the transaction must be completed or expressly authorized by the student’s parent or legal guardian.
Online ground-school purchases provide only the access, materials, and services described in the applicable course listing. Course access is personal to the enrolled student and may not be transferred, resold, shared, or used by another person.
A discovery-flight or pilot-training reservation holds a requested appointment but does not guarantee that a flight will occur at the originally scheduled time. Flights and training may be delayed, rescheduled, modified, or canceled because of weather, aircraft availability or maintenance, instructor availability, airport conditions, safety considerations, regulatory requirements, or other operational circumstances. East Aviation’s applicable cancellation, rescheduling, credit, and refund policies will govern these situations.
Unless a service is expressly advertised as a fixed-price package, displayed training costs are estimates or current rates only. The total cost of pilot training varies based on the student’s progress, proficiency, preparation, frequency of training, aircraft and instructor time, weather, scheduling, FAA requirements, and any additional training needed to meet applicable standards.

Prices for courses, discovery flights, aircraft use, flight instruction, ground instruction, training packages, and related services are displayed on the website or applicable payment page. East Aviation may change its prices and rates at any time; however, price changes will not alter a completed purchase except where the website contained an obvious or inadvertent pricing error.

If a pricing error is discovered after a purchase or reservation, East Aviation may notify the purchaser and offer the choice of paying the correct price or canceling the affected purchase or reservation for a refund of the amount paid. Applicable taxes and any clearly disclosed third-party or processing charges may be added at checkout.

All purchases, course access, reservations, cancellations, rescheduling requests, credits, and refunds remain subject to East Aviation’s applicable policies and any separate enrollment, training, rental, or participation agreement.

Refund and Return Policy

Non-Customized Merchandise

Unused and undamaged, non-customized merchandise may be returned within 30 days after delivery. Returned merchandise must include its original packaging, accessories, and proof of purchase. Approved refunds will be issued to the original payment method.

Original shipping charges and return-shipping costs are nonrefundable unless the merchandise was damaged, defective, or shipped incorrectly by East Aviation.

Customized Merchandise

Customized, personalized, engraved, or made-to-order merchandise is not eligible for a monetary refund. Eligible returns of customized merchandise may receive East Aviation credit only. Merchandise that has been used, worn, altered, or damaged after delivery is not eligible for return or credit.

Online Ground School No-Pass Guarantee

East Aviation’s online ground school includes a No-Pass Guarantee. If a student completes the ground-school program but does not pass the applicable FAA knowledge test, the student may choose either:

A full refund of the $249 ground-school purchase price; or
Additional written-test preparation and retraining from East Aviation at no additional cost.

To request the guarantee, the student must provide East Aviation with a copy of the official FAA knowledge-test results. The No-Pass Guarantee applies only to the ground-school purchase price and does not reimburse FAA testing fees, travel expenses, books, supplies, or other third-party costs.

Flight-Training Purchases and Credits

Refunds for prepaid flight-training packages, hours, or account credits apply only to the remaining unused portion. Training, instruction, aircraft time, supplies, fees, or other services already provided are nonrefundable. Any approved refund will be calculated using the student’s remaining eligible unused hours or credits.

Aircraft Rental

Aircraft-rental refunds apply only to unused prepaid aircraft-rental hours. Aircraft time already flown, reserved and charged under an applicable cancellation policy, or otherwise used is nonrefundable.

Discovery Flights

Discovery-flight purchases and gift certificates are nonrefundable. If East Aviation is unable to conduct a discovery flight because of weather, aircraft maintenance, instructor availability, safety considerations, or other operational circumstances, the flight may be rescheduled or an East Aviation credit may be issued. No cash refund will be provided.

Refunds, returns, credits, and rescheduling remain subject to verification of the purchase and compliance with East Aviation’s applicable enrollment, scheduling, cancellation, and attendance policies.

Termination of Products or Services

We may, without prior notice, change the services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.

Termination of Service

We may permanently or temporarily terminate or suspend your access to the service without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulations. You may discontinue use and request to cancel your account and/or any services at any time. Notwithstanding anything to the contrary in the foregoing, with respect to automatically-renewed subscriptions to paid services, such subscriptions will be discontinued only upon the expiration of the respective period for which you have already made payment

Eligibility; Students Under the Age of Majority

You may use this website and purchase or receive services from East Aviation if you have reached the legal age of majority in your jurisdiction and have the legal capacity to enter into these Terms. The general age of majority in Alabama is 19.

Students who are at least 13 years old but have not reached the legal age of majority may use this website and receive East Aviation services only with the knowledge, supervision, authorization, and express consent of a parent or legal guardian. The parent or legal guardian must review and accept these Terms, provide accurate registration and enrollment information, and complete any additional agreements, acknowledgments, authorizations, releases, or waivers required by East Aviation.

By authorizing a minor’s use of this website or participation in East Aviation services, the parent or legal guardian:

Represents that they have the legal authority to act for the minor;
Consents to the minor’s participation in the requested services;
Accepts these Terms personally and, to the fullest extent permitted by applicable law, on behalf of the minor;
Accepts responsibility for the minor’s website activity, conduct, purchases, fees, cancellations, and compliance with East Aviation policies; and
Agrees to supervise the minor’s use of the website and services when appropriate.

Individuals under 13 may not create an account, make a purchase, submit personal information, or enroll themselves through this website. A parent or legal guardian must complete all website interactions, purchases, registrations, and enrollment activities on their behalf.

East Aviation may require proof of age, identity, or parental or guardianship authority and may suspend or deny access until satisfactory authorization is received. Meeting these age requirements does not replace any applicable FAA eligibility requirement, medical qualification, student-pilot certification requirement, identification requirement, or East Aviation enrollment or safety requirement.

You may not use this website or receive services if doing so is prohibited by applicable law or regulation.

Indemnification

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless East Aviation and its owners, officers, employees, instructors, independent contractors, agents, affiliates, participating locations, and service providers from and against any third-party demands, actions, claims, damages, losses, liabilities, judgments, penalties, costs, or expenses, including reasonable attorneys’ fees, arising from or related to:

Your misuse of eastaviation.net, an online ground-school course, a reservation system, or any other website feature or service;
Your violation of these Terms, an East Aviation policy, or applicable law;
Information or content you submit through the website;
Your infringement or violation of another person’s rights;
Fraudulent, negligent, unauthorized, or unlawful conduct by you; or
Your failure to provide accurate information or obtain any required parent, guardian, student, or third-party authorization.

East Aviation may assume control of the defense of any matter subject to indemnification, and you agree to provide reasonable cooperation. You may not settle a claim affecting East Aviation without East Aviation’s prior written consent.

When a parent or legal guardian authorizes a minor to use the website or receive East Aviation services, the parent or legal guardian accepts this indemnification obligation personally and, to the fullest extent permitted by law, on behalf of the minor.

This provision does not require you to indemnify East Aviation for liability resulting solely from East Aviation’s gross negligence, willful misconduct, or any liability that cannot legally be limited or transferred.

Website and Online-Service Limitation of Liability

To the fullest extent permitted by applicable law, East Aviation and its owners, officers, employees, instructors, independent contractors, agents, affiliates, participating locations, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your access to, use of, or inability to use eastaviation.net or its online services. This limitation includes loss of profits, revenue, business opportunities, goodwill, data, course progress, account access, or other intangible losses, regardless of the legal theory asserted and even if East Aviation has been advised that such damages may occur.

To the fullest extent permitted by applicable law, East Aviation assumes no liability or responsibility for:

Errors, omissions, typographical mistakes, outdated information, or inaccuracies in website content;
Temporary interruptions, delays, technical failures, loss of course progress, or inability to access the website, online ground school, payment system, or reservation system;
Actions taken in reliance upon general information presented on the website;
Viruses, malicious code, service disruptions, or other harmful components transmitted through the website or a third-party service;
Unauthorized access to or use of East Aviation’s servers, systems, accounts, payment information, or stored personal information, despite reasonable security measures;
Conduct, content, products, services, or availability of third-party websites, payment processors, scheduling providers, instructors, aircraft providers, or other independent service providers; or
The cancellation, delay, or rescheduling of a discovery flight, aircraft rental, or pilot-training appointment because of weather, aircraft maintenance or availability, instructor availability, airport conditions, safety considerations, regulatory requirements, or other operational circumstances.

East Aviation makes reasonable efforts to provide accurate and current aviation-training information; however, website and course materials are provided for educational purposes and do not replace current FAA regulations, official FAA publications, aircraft operating limitations, an instructor’s direction, or the exercise of sound aeronautical decision-making. Except for East Aviation’s expressly stated Ground School No-Pass Guarantee, East Aviation does not guarantee that use of the website or completion of a course will result in passing an examination, earning an FAA certificate or rating, completing training within a particular number of hours, or achieving any other specific result.

To the fullest extent permitted by law, East Aviation’s total liability arising from a website-based purchase or online service will not exceed the amount you paid East Aviation for the specific product or service giving rise to the claim.

These limitations apply only to eastaviation.net and its website-based and digital services. Participation in flight training, discovery flights, aircraft rental, aircraft operations, or other in-person aviation activities is governed by separate enrollment agreements, operating policies, acknowledgments, and liability releases.

Nothing in these Terms excludes or limits liability for East Aviation’s gross negligence, willful misconduct, fraud, or any other liability that cannot lawfully be excluded or limited.

Changes to These Terms

East Aviation reserves the right to revise or update these Terms from time to time at its discretion to reflect changes in its website, online ground school, discovery flights, pilot-training services, aircraft-rental services, business practices, safety policies, or legal and regulatory requirements.

The current version of these Terms will be posted on eastaviation.net and will identify its effective or last-updated date. You are responsible for reviewing the Terms periodically.

When East Aviation makes a material change, we will provide reasonable notice by posting a notice on the website, sending an email to the address associated with your account, or using another appropriate method. Unless otherwise stated, revised Terms become effective when posted and apply prospectively to future website use, purchases, reservations, and services.

Your continued use of eastaviation.net or East Aviation’s services after revised Terms become effective constitutes your acceptance of those revisions. If you do not agree to the current or any future version of these Terms, you must discontinue using the website and may not make additional purchases or reservations.

Unless required by law or necessary for safety or regulatory compliance, a change to these Terms will not retroactively alter the price, refund rights, or material conditions of a purchase or reservation completed before the revised Terms became effective.

Communications and Marketing Consent

East Aviation may use the contact information you provide to send transactional or service-related communications concerning your account, online ground-school access, payments, purchases, discovery-flight reservations, pilot-training appointments, aircraft scheduling, cancellations, safety information, and other services you request. These communications are necessary to administer your account or services and are not promotional messages.

If you separately choose to receive promotional communications, you authorize East Aviation to send you information about courses, flight-training programs, discovery flights, aircraft availability, events, merchandise, special offers, and other East Aviation news by email, postal mail, telephone, or text message using the contact information you provide. Where permitted and disclosed at the time of enrollment, calls or texts may be sent using automated technology.

Consent to receive promotional calls or text messages is not a condition of purchasing or receiving any East Aviation product or service. Message frequency may vary, and standard message and data rates may apply.

You may withdraw your consent to promotional communications at any time:

For marketing emails, select the “unsubscribe” link included in the message.
For marketing text messages, reply STOP.
For telephone calls, tell the caller that you do not wish to receive further promotional calls.
For postal mail or other communications, contact East Aviation using the contact information published on eastaviation.net.

East Aviation will process opt-out requests within the time required by applicable law. Opting out of promotional communications will not prevent East Aviation from sending necessary transactional, scheduling, payment, safety, account, or service-related communications.

Governing Law and Venue

These Terms, your use of eastaviation.net, and any dispute, claim, or cause of action arising from or relating to the website, an online ground-school purchase, a discovery-flight reservation, pilot-training services, aircraft-rental services, merchandise, or any other East Aviation product or service will be governed by and construed under the laws of the State of Alabama, without regard to its conflict-of-laws principles.

Unless applicable law requires otherwise, any legal action or proceeding arising from or relating to these Terms or East Aviation’s products or services must be brought exclusively in:

A state court of competent jurisdiction located in Colbert County, Alabama; or
If federal jurisdiction exists, the United States District Court for the Northern District of Alabama, Northwestern Division.

You consent to the personal jurisdiction of these courts and waive any objection based upon venue or an inconvenient forum.

Nothing in this section limits a consumer right or remedy that cannot lawfully be waived or prevents either party from bringing an eligible individual claim in a court of proper small-claims jurisdiction.

The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms or any purchase from East Aviation.
